O R D E R
The writ petition has been filed for the following reliefs: "to issue directions to the Respondent herein to consider the petitioners representation dated 28/07/2025 and to disburse the balance 25 percent GPF amount and Encashment of Surrender of Earned Leave amount within a limited time frame as deemed fit by this Honourable Court."
2. The petitioner had joined the services of the respondent as a Helper on 20.08.1987 and had attained the age of superannuation on 30.03.2024. However, due to suspension, he was not allowed to retire from the service.
3. The petitioner would submit that he has been falsely implicated and arrested on 18.03.2021 in a criminal case for allegedly accepting illegal gratification from one P.Kanagaraj for the issuance of an agricultural electricity connection. Since he was arrested, the 2/5
respondent had suspended him from service vide order dated 20.03.2021 with effect from 18.03.2021. The criminal case has been pending investigation without the filing of a charge sheet since 18.03.2021.
4. The petitioner would submit that on 30.03.2024 he had attained the age of superannuation. However, the respondent by order dated 30.03.2024 had not permitted him to retire from service. Thereafter, by order dated 05.07.2024, the respondent had given only 75% of the GPF amount. However, the remaining 25% of the GPF amount and the encashment of the surrender of earned leave benefit have not been paid to him to date. Aggrieved by the same, the petitioner had given a representation dated 28.07.2025 to the respondent. However, the same has not been considered to date. Hence, the Writ Petition.
5. Heard the learned counsel on either side.
6. Considering the facts and circumstances of the case and 3/5
taking note of the fact that the criminal case has been pending investigation without the filing of a charge sheet since 18.03.2021, the Writ Petition is allowed. The respondent is directed to consider the petitioner's representation dated 28.07.2025 in accordance with law and pass orders within a period of 2 months from the date of receipt of a copy of this order. No costs.
