Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 4th respondent to forthwith cancel the patta in the names of third parties in the Survey Numbers 182/5 , 185/4 , 187/1 and 182/2 measuring 1.66 acres situated Sekkadu Village, Avadi Taluk, Thiruvallur district based on the order passed by the 3rd respondent vide Na.Ka.No. 2896/ 2022/ A5 dated 1/6

ORDER

This writ petition has been filed to direct the 4th respondent to forthwith cancel the patta of the subject property in the names of third parties based on the order dated 04.12.2024 passed by the 3rd respondent and consequently directing the respondents to restore the patta in the name of the petitioner.

2. Mr.D.Ravichander, learned Special Government Pleader, takes notice on behalf of the respondents.

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

The learned counsel for the petitioner would submit that in this case, a detailed enquiry was conducted by the 3rd respondent and thereafter, an order dated 04.12.2024 was passed to cancel the forged patta, which was issued against the 3rd parties and also to restore the patta in the name of the petitioner. Though the said order was passed as early as on 04.12.2024, the same was not implemented by the respondent till date. Hence, this writ petition.

5. In reply, the learned Special Government Pleader appearing for the respondents would request this Court to pass appropriate orders directing the respondents to consider and dispose of the representation filed by the petitioner.

6. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and also perused the materials available on record.

7. In the case on hand, an order dated 04.12.2024 was passed by the 3rd respondent to cancel the forged patta, which was issued against the 3rd parties and also to restore the patta in the name of the petitioner However, the said order was not implemented by the respondents till date.

8. In view of the above, this Court directs the 4th respondent to implement the order dated 04.12.2024 passed by the 3rd respondent within a period of 4 weeks from the date of receipt of a copy of this order.

9. With the above directions, this writ petition is disposed of. No costs.
