ORDER

This petition has been filed to call for the entire records in connection with the charge-sheet in C.C.No.46 of 2023, pending on the file of the Judicial Magistrate Court, Sankarapuram, and quash the same.

2. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the petitioners are involved in the offences under Sections 498-A, 294(b) and 506 (Part-I) IPC, and also under Section 4 of the Dowry Prohibition Act and FIR has been registered based on the complaint made by the second respondent on 14.09.2021.

3. It is further submitted by the learned Government Advocate that the victim girl has given statement against the petitioners with regard to their involvement in the said offences. There are prima-facie materials against the petitioners to further proceed with the case as against the petitioners. Hence, this Court is not inclined to quash the charge-sheet in C.C.No.46 of 2023 pending on the file of the Judicial Magistrate Court, Sankarapuram. Hence, this petition is dismissed. However, the petitioners are at liberty to treat the grounds taken by the petitioners in this petition, which are nothing but defences of the 2 / 4

petitioners/accused. The first respondent is directed to secure the petitioners/accused and the petitioners are at liberty to take all their defences before the trial Court during the course of trial. Consequently, the miscellaneous petition is closed.
