ORDER

This Criminal Original Petition has been filed to modify the condition imposed by the learned Principal District and Sessions Judge, Erode in Crl.M.p.no.2003 of 2025 dated 28.07.2025 that the petitioner shall deposit a sum of Rs.71,115/- before the Judicial Magistrate No.III, Erode in Cr.No.146 of 2025.

2. The learned counsel for the petitioner submitted that at the time of enlarging the petitioner on bail in Crl.M.P.No.2003 of 2025, the learned Principal District and Sessions Judge, Erode has imposed conditions and one of such conditions is that the petitioner shall deposit a sum of Rs.71,115/- in Cr.No.146/2025 before the Judicial Magistrate No.III, Erode. He further submitted that the condition imposed on him is too onerous and owing to petitioner's financial constraints, he is not in a position to mobilise funds, so as to deposit before the court and due to non payment of the said amount, he is still

under judicial custody. Thus, he prayed for modification of the above said condition imposed on him by the court below.

3. Heard the learned Govt. Advocate (crl.side) appearing for the respondent.

Considering the submissions of the learned counsel for the petitioner, the condition 'ii)' imposed by the Principal District and Sessions Judge, Erode in Crl.M.P.No.2003 of 2025 on 28.07.2025 is modified to the effect that the petitioner shall deposit a sum of Rs.40,000/- (Rupees forty thousand only) within a period of one week from the date of receipt of a copy of this order in the court of the Judicial Magistrate No.III, Erode, in Cr.No.146 of 2025 on the file of CSCID Police Station, Erode and the bail bond shall be issued only after such deposit.

6. Except the above modification, the other conditions imposed on the petitioner shall remain unaltered.

7. With the above modification, this Criminal Original Petition is disposed of .
