ORDER

This Criminal Revision Case has been filed against the order dated 19.07.2025 passed in Na.Ka.No.5475-2018A on the file of Revenue Divisional Officer, Madhuranthakam, thereby directed both the counter parties including the petitioners that they shall not encroach the subject property. 2.

Heard, the learned counsel for the petitioner, the learned Government Advocate(crl.side) appearing for respondents 1 & 2, and perused all the materials placed before this Court.

There was a dispute between the petitioners and respondents 4 & 5 herein in respect of the enjoyment of the land comprised in survey No.114/12, new survey No.114/14 situated at Thandarai Puducherry Village, Madhuranthakam Taluk, Chengalpattu District. Therefore, on a complaint, it was referred before the first respondent for initiation of proceedings under Section 145 of Cr.P.C. After issuance of notice to all the parties, on the strength of the report submitted by the second respondent, it was found that the said land

is classified as Government vacant natham land. No party had produced document to show that they are in possession and they owned the said property. Therefore, both the parties are considered encroacher and as such both the parties were directed not to encroach the subject property. As such, this Court finds no infirmity or illegality in the impugned order. 4.

In view of the above discussion, this criminal revision case is dismissed. However, the petitioners or the counter parties are at liberty to approach the civil court for appropriate relief in respect of the subject property.
