ORDER

This petition is listed today at the instance of the learned counsel for the petitioner.

2. The grievance of the petitioner is that despite the direction of this Court to the Trial Court to dispose of the application within two months, the Trial Court is facing difficulty and is under the impression that only after conclusion of the trial, the application can be decided.

3. This Court is of the view that for deciding the application under Section 8 of the TNPID Act, one need not wait for conclusion of the Trial. Since this Court has already directed the Trial Court to dispose of the application filed to raise the attachment of the petitioner's property, the Trial Court shall dispose of the said application in terms of the findings already recorded and need not wait till the trial is over. This Court has also recorded that the transfer is not a mala fide.

4. Accordingly, the Trial Court shall dispose of the application within a period of one month from the date of receipt of a copy of this order. 03-12-2025 mrp
