Petition is filed to call for the records pertaining to C.C.No.134 of 2021 in Crime No.01 of 2021 on the file of the learned Judicial Magistrate No.I, Kancheepuram.

2. Petitioner seeks quash of the case in C.C.No.134 of 2021 on the file of the learned Judicial Magistrate No.I,Kancheepuram. The charge is for the offence under Sections 323, 498(A) of IPC. The defacto complainant is the wife of the petitioner herein.

3. The learned counsel for the petitioner submitted that, parties have arrive at a compromise. The compromise memo has been filed before the Sub Court, Kancheepuram in H.M.O.P.No.163 of 2023, in which, parties have referred about the pendency of the criminal case and decided to withdraw the case after obtaining mutual consent. The said H.M.O.P is adjourned to 04.01.2024.

4. In view of the above, this Court directs the petitioner to work out his remedy before the trial Court after the disposal of H.M.O.P. With this liberty, this Criminal Original Petition is disposed of. 08.11.2023 Index : Yes/No Sma To
