This petition is filed to condone the delay of 437 days in filing the appeal.

Heard Mr.B.Arjunan, learned counsel for the petitioner and Mr.R.Daya Shariff, learned counsel for the respondent.

Even though some reasons have been stated in the affidavit filed in support of this petition to condone the delay of 437 days, as the petition is objected by the sole respondent, we, after considering all these aspects, are inclined to condone the delay of 437 days in filing the appeal, of course, on terms.

The petitioner shall pay a sum of Rs.2,000/- to the respondent through the learned counsel for the respondent.

The petition stands ordered on the aforesaid terms.
