O R D E R
This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to consider the representation made by the petitioner wherein the petitioner has sought for the disbursement of the provident fund amount to the tune of Rs.1,48,200/- within the time frame fixed by this Court.
2. Heard Ms.G.Sridevi, learned counsel for petitioner, Mrs.J.Sreevidhya, learned Standing Counsel appearing for first respondent, Mr.K.Tamilvendan, learned Government Advocate appearing for second respondent and Dr.T.Seenivasan, learned Special Government Pleader appearing for third respondent.
3. The case of the petitioner is that he was working as an Assistant in Namakkal Municipality. The petitioner submitted an application for permitting him to go on voluntary retirement from 2/4
30.08.2024. The petitioner was permitted to go on Voluntary Retirement Scheme.
4. The grievance of the petitioner is that a sum of Rs.1,48,200/-, which was recovered from the salary of the petitioner towards General Provident Fund was not paid to the petitioner since it was credited into a wrong account. Thereafter, various communications were made and the petitioner ultimately received a letter from the District Treasury Officer dated 24.06.2024 stating that the petitioner must contact the employer with whom he was working at the time of retirement. The petitioner thereafter sent a reminder to the third respondent on 20.08.2024 by marking a copy to the first respondent. The respondents 1 and 3 have not passed any orders till date and in view of the same, the sum of Rs.1,48,200/- to which the petitioner is entitled has not been paid to the petitioner. It is under these circumstances, the present writ petition has been filed before this Court.
5. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the petitioner to make a fresh representation to all the respondents 3/4
N.ANAND VENKATESH, J gm along with relevant documents and also a copy of this order. On receipt of the same, necessary proceedings shall be issued and the sum that is due and payable to the petitioner towards the provident fund shall be disbursed to the petitioner within a period of four (4) weeks from the date of receipt of fresh representation from the petitioner. This writ petition is disposed of with the above direction. No costs.
