This Petition has been filed to condone the delay of 382 days in filing the appeal.

2.Heard the learned counsel for the Petitioner and the learned counsel for the Respondent.

3.It is seen from the averment made in theaffidavit filed in support of this Petition that instead of filing the Appeal before this Court, the Petitioner has preferred the same before the Principal District Court, Erode and the same was returned. Thereafter, an Appeal has been preferred before this Court with the delay of 382 days. Since the above is not the ground to reject this Petition, this condone delay Petition is ordered on payment of Rs.500/- as costs to the learned counsel for the Respondent in this Petition, within a period of one week from the date of receipt of a copy of this order.

4.Registry is directed to number the Appeal Suit, if it is otherwise in order and print the name of Mr.R.Prabakar, as learned counsel for the Respondent at the time of admission.
