ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.02.2024, for the offences punishable under Sections 5(l), 5(m), r/w 6 (1) of POCSO Act, 2012 in Crime No.03 of 2024, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner and the children are neighbours. It is alleged that when the children were playing he took 3 children to his house and committed sexual assault on them. Based on the complaint given by one of the father of the victim the respondent police has registered a case.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he is in judicial custody from 03.02.2024. . He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted totally three children were affected by the 2/4

petitioner and the trial is in progress and totally 8 witnesses were examined and one witness is not yet examined and the case is now posted for examination of L.W.9.

5. Considering the fact that the trial is in progress and 8 witnesses were examined and the case is posted for examination of one more witness, this Court is of the view that granting bail is not necessary at this stage. Hence, this Criminal Original Petition stands dismissed . 24.09.2025 smn To
