O R D E R

This petition has been filed to call for the records and quash the private complaint in C.C.No.1350 of 2002, pending on the file of the learned XIV Metropolitan Magistrate, Egmore, Chennai.

2. The learned counsel for the petitioners submitted that the respondent had filed a private complaint against the petitioners. Though the petitioners served notice to the respondent, the respondent had failed to appear before this Court. There is a civil suit pending against the petitioners. The petitioners and the other accused are suffering due to the pendency of the above petition. Further, the petitioners submitted that it would be suffice if the trial Court is directed to complete the trial within a stipulated time, so that the petitioner could be able to prove the false claim of the respondent and a civil suit has been given a criminal colour.

3. In view of the above submission, the Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is also closed.
