The petitioners seek bail in Crime Nos.306 & 307 of 2023.

2. It is stated that originally Crime No.306 of 2023 has been registered against the petitioners for the offences under Sections 294(b), 341, 395, 397, 506(ii) of IPC and they were remanded to judicial custody on 30.08.2023 3.It is also stated that they had restrained the defacto complainant, abused him and assaulted him with hands and stone and robbed a sum of Rs.5,000/- and also his cell phone.

4.It is however seen that the respondent Police were trying to chase the petitioners herein and they committed the second offence in Crime No.307 of 2023 wherein it is stated that they were preparing to commit dacoity, for which, the offence under Sections 294(b), 307, 353, 399, 506(ii) of IPC have been registered against them. 5.It is stated by the respondent Police that the petitioners 1 to 3 have been detained under Act 14 of 1982 on 07.10.2023. 1/2 https://www.mhc.tn.gov.in/judis

Crl.OP.Nos.23381 & 23454 of 2023 C.V.KARTHIKEYAN.J., vkr 6.The learned counsel for the petitioner stated that one of accused namely Devanathan had been granted bail by this Court in Crl.O.P.No.22127 of 2023 on 26.09.2023 with respect to the offence in Crime No.306 of 2023. The same accused Devanathan was also granted bail in Crl.O.P.No.22268 of 2023 on 06.10.2023 with respect to the offence in Crime No.307 of 2023.

7.The learned Government Advocate stated that there is no previous case against the said Devanathan.

8.In view of the nature of the offence and they had prepared to commit the offence once again and taking into account A1 to A3 have been detained under Act 14 of 1982, at this stage, this Court is not inclined to grant bail to the petitioners 4 to 6.
