2. N. Rangasami S/o. Nachiyappan ... Respondents This case came up for settlement before the National Lok Adalat. Appellant and the respondent are present. The learned counsel appearing for the appellant Mr.D. Bhaskaran and Mr.K. Myilsamy, the learned counsel appearing for the 1st respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT Originally, the Trial Court has awarded a total sum of Rs.23,00,000/- (Rupees Twenty Three Lakhs) to be payable to the respondents with cost and interest at the rate of 7.5% per annum as compensation. Aggrieved by the said award amount, the petitioner Insurance Company has preferred the above appeal.

2. Both the parties are present and arrived at a settlement for a sum of Rs.11 lakhs with interest @ 7.5% p.a. From the date of petition till the date of deposit. The appellant agreed to deposit the said amount within a period of 6 weeks from the date of this order.

3. After negotiation, the award is as follows:

The parties have agreed for a sum of Rs.11,00,000/- (Rupees Eleven Lakhs only) with interest @ 7.5% p.a. from the date of petition till the date of deposit.

(ii) The appellant is directed to deposit the amount within a period of 6 (six) weeks from the date of this order.

(iii) The appellant / petitioner is at liberty to recover the award amount from the owner of the vehicle.

4. With the above settlement, the Award is passed. Consequently, the connected miscellaneous petition is closed.
