This petition has been filed to implead the proposed 9th respondent in the present writ petition.

2. This court, by order dated 08.08.2022, in paragraph 8 of the order, has held as follows:

"... In view of the reasons highlighted above, we deem it fit that such an officer has to face the departmental proceedings. Therefore, the first respondent is directed to initiate departmental proceedings by issuing notice under Section 17(b) of the Tamil Nadu Civil Services (Discipline & Appeal) Rules against the official concerned for filing a wrong counter affidavit with an oblique motive to misrepresent this Court and also that he has supported the violators. It is also made clear that since the stop work, lock and seal, demolition and de-occupation notices highlighted above were already been issued, the third respondent is directed to implement the process and file a report before this Court after four weeks.

Even though the official Mr.S.Mathivanan had appeared before us on 03.08.2022, to offer his explanation convincing his stand, we are unable to find any substance and merits in his explanation."

3. Now the petitioner/proposed 9th respondent has filed an impleading application in the present writ petition. There is no D.KRISHNAKUMAR, J.

mrn substance in entertaining the said application. Therefore, we are not interfering with the earlier order of this Court dated 08.08.2023 passed as against the proposed 9th respondent. Consequently, the impleading petition is closed.

4. It is for the first respondent to conduct the enquriy independently subject to satisfaction of the explanation and materials submitted by the petitioner herein, in accordance with law.
