O R D E R

The Writ Petition is filed for the following relief: "directing the respondent to pay the pension under thee revised UGC 7th pay pursuant to petitioner representation dated 28.06.2024".

2. The petitioner is a retired professor of Physiology, Faculty of Medicine of Annamalai University and attained superannuation on 30.06.2006. The service under the respondent was 32 years, 3 months and 3 days and the petitioner is entitled for the full pension as per the UGC norms and revised pension GO. The petitioner has not received his regular revised pension and he made several representations from October 2007 to release his regular pension.

3. The first two and half years after his retirement i.e., from 01.07.2006 to 31.12.2008 he did not receive any pension. From 01.01.2009 to 30.08.2013 for a period of 56 months he received only an unrevised pension basic of Rs.13,955/- without any allowance minus the commuted pension. From 01.09.2013 to 31.03.2019 for a period of 2/6

67 months the petitioner received only the unrevised pension basic of Rs.13,955/- with the existing DA of Rs.8,131/- minus the commuted pension of Rs.4,651/- and he received Rs.18,355/- per month as consolidated pension.

The petitioner filed WP.No.1238 of 2018 and this Court by order dated 15.12.2017 directed the respondent therein to settle the pensionary benefits due to the petitioner taking into account his date of retirement as 30.06.2006 and consequently pay the revised pay and pension in accordance with the rules. From 01.04.2019 to 30.09.2020 for a period of 18 months the petitioner received an unknown basic of Rs.23,735/- per month with DA and the basic shown therein was not the VI UGC pay. Many of the retired professors under the respondent who were working in the faculty of Medicine and other faculties were drawing pension under the revised UGC, 7th pay. One of the retired professors, who is the member of Annamalai University Teachers Association is drawing a revised pension basic of Rs.85,000/-.

5. The petitioner alone is not receiving the proper pension under 3/6

the revised UGC 7th pay. The petitioner has made a representation dated 28.06.2024 to the respondent to consider the above facts. Since there is no response the petitioner is before this Court.

6. Heard the learned counsels and perused the records.

7. Considering the facts and circumstances of the case and the fact that the petitioner's representation dated 28.06.2024 has not been considered to date the Writ Petition is allowed. Further, there is no explanation for this huge disparity between similarly placed employees. The respondent is directed to consider the petitioner's representation dated 28.06.2024 and pass order on merits within a period of 2 months from the date of receipt of a copy of this order.
