Learned counsel has made an endorsement in the application, a scanned reproduction of which is as follows:

Learned counsel reiterates the aforementioned endorsement. In the light of the endorsement and reiteration of the same in 1/3

the hearing, captioned application is dismissed as withdrawn albeit preserving all the rights and contentions of the plaintiffs to proceed against entities, individuals other than the defendants, if new facts come to light. There shall be no order as to costs.
