O R D E R

The petitioner, who was arrested and remanded to judicial custody on 25.07.2025, for the offence punishable under Section 6 of POCSO Act, 2012 and 9 of PCM Act in Cr.No.140 of 2025, on the file of the respondent, seeks bail.

2. The respondent police on the complaint given by the father of the minor child, has registered an FIR on 13.07.2025. The petitioner and the minor victim girl was secured on 21.07.2025. In the meanwhile, it appears that this petitioner tied Thali to the minor child and had intercourse with her.

3. The learned Additional Public Prosecutor (Pondycherry) the minor victim girl is born on 10.07.2008 and due to instagram acquaintance, she had eloped with the petitioner herein and she was subjected to sexual intercourse.

4. Per contra, the learned counsel appearing for the petitioner states that it is a love affair between two adolescent persons and the petitioner is ready to marry the victim girl and it was consensual sex.

5. In any event, having sex with the minor girl even by consent is legally prohibited. Taking note of the fact that final report not yet filed and investigation is at nascent stage, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition for bail stands dismissed for the present.
