5/8 COMMON ORDER While WPMP (Crl). Nos.394 & 396 of 2025 have been filed seeking to recall the common order dated 26.09.2022 passed by this Court in W.P.Nos.3441 & 3445 of 2022 by the fourth respondent in the writ petitions, WPMP (Crl). Nos.411 & 412 of 2025 have been filed by a third party to the said writ petitions who is also aggrieved by the common order dated 26.09.2022. 2.The learned counsel for the petitioner in WPMP (Crl). Nos.394 & 396 of 2025 would submit that the petitioner was arrayed as fourth respondent in W.P.Nos. 3441 & 3445 of 2022; when the aforesaid writ petitions came up for hearing on 26.09.
2022, the writ petitioners had informed the Court that the matter had been compromised, based on which submission, the writ petitions were closed; however, the fact remains that no such compromise was effected between the parties; and in fact, based on the so called compromise, the writ petitioners have also obtained a civil court decree. 3.
6/8 petitions since there was a compromise effected and thereafter, the writ petitioners have also filed a suit before the Court concerned. 4.Heard the learned counsel for the petitioners, learned counsel for the first respondent and the learned Additional Public Prosecutor for R2 to R4. 5.The writ petitions have been closed on 26.09.2022. It is also admitted by the writ petitioners that they have withdrawn the writ petitions. Needless to state, it is the prerogative of the writ petitioners to withdraw the writ petitions. At the instance of the petitioners herein, the order dated 26.09.2022 cannot be recalled.
6.In view of the foregoing reasoning, these writ miscellaneous petitions are closed. However, the petitioners are permitted to raise all their objections before the appropriate civil forum. Consequently, the impleading petitions in WPMP Crl.Nos.510, 511 & 513 of 2025 are also closed. 27-10-2025 sli
