Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, Directing the 1st and 2nd respondents to consider the petitioner representation dated 03.07.2025 and disposed the same, and consequently to make correction in the 4th to 8th respondents FMB Sketch in old survey 835/ 1b /1b/1, new survey no.1853/ 20 and fix time frame manner For Petitioner : Mr.T.Meganatha For Respondent : Mr.D.Ravichander, SGP for R1 to R3

ORDER

This writ petition has been filed to direct the 1st & 2nd respondents to consider the petitioner's representation dated 03.07.2025.

2. Mr.D.Ravichander, learned Special Government Pleader, takes notice on behalf of the respondents.

3. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

The learned counsel for the petitioner would submit that in this case, the petitioner's house is situated at Survey No.835/1b/1b/1 (New survey No.1853/19), which is adjacent to the 4th respondent's property in very same survey number (New Survey No.1853/20). Under these circumstances, the respondents 1 to 3 had wrongly mentioned the 4th respondent's FMB Sketch as square meter in 5.0 meter instead of 4.8 meter, due to which, there was a dispute between the parties. Therefore, the petitioner made representation dated 03.07.2025 to make necessary correction in the 4th respondent's FMB Sketch. However, the said representation was not at all considered by the respondent till date. Hence, this writ petition.

5. In reply, the learned Special Government Pleader appearing for the respondents would request this Court to pass appropriate orders directing the 1st & 2nd respondents to consider and dispose of the representation filed by the petitioner.

6. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and also perused the materials available on record.

In the case on hand, the petitioner's house is situated at Survey No.835/1b/1b/1 (New survey No.1853/19), which is adjacent to the 4th respondent's property in very same survey number (New Survey No.1853/20). Under these circumstances, the respondents 1 to 3 had wrongly mentioned the 4th respondent's FMB Sketch as square meter in 5.0 meter instead of 4.8 meter, due to which, a dispute arose between the respondents 4 to 8 and the petitioner. Therefore, the petitioner made representation dated 03.07.2025 to make necessary correction in the 4th respondent's FMB Sketch. However, the said representation was not considered by the 1st & 2nd respondents till date.

8. In view of the above, this Court directs the 1st & 2nd respondents to consider the petitioner's representation dated 03.07.2025 within a period of 4 weeks from the date of receipt of copy of this order. 4/6

9. With the above directions, this writ petition is disposed of. No costs.
