Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 to 5 to survey the petitioner land and fix the boundaries, with cost of the petitioner, in the Old S.No.306/1 and New S.No.527/1, Oodaiyam Village, Kangayam Taluk, in the extent of 2.24 Acres as per the partition deed in Doc No.2774/1981 dated 05.10.1981.

ORDER
This Writ Petition has been filed seeking a direction to the respondents 1 to 5 to survey the petitioner's land and fix the boundaries, with cost of the petitioner, comprised in the Old S.No.306/1 and New S.No.527/1, admeasuring 2.24 acres, situated Oodaiyam Village, Kangayam Taluk, as per the Partition Deed in Doc No.2774 of 1981 dated 05.10.1981.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner owned a land comprised in Old S.No.306/1 and New S.No.527/1, admeasuring 2.24 acres, situated Oodaiyam Village, Kangayam Taluk. In order to survey the said land, the petitioner submitted an application before the fourth respondent and also paid requisite fees for the same. So far the fourth respondent did not take any steps to survey and demarcate the land belongs to the petitioner. Hence, this writ petition.

In view of the above, the fourth respondent is directed to survey the petitioner's aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject property, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.
5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
