O R D E R
The Writ Petition is filed for the following relief: "directing the respondent herein to consider petitioner's representation dated 09.08.2021 and confer compassionate appointment to petitioner's 2nd son namely U. Surya in any of the existing vacancy and also confer the death benefits and family benefits within reasonable time".
2. The petitioner's husband, namely, M.Udayan was employed in the respondent's concern as a Heavy Vehicle Driver and died in harness on 19.07.2021. He died intestate leaving behind the petitioner and his sons, namely, U.Magesh and U.Surya. It is submitted that disciplinary action and a criminal action was initiated against the deceased for causing a motor accident in the year 2001. After the enquiry in disciplinary proceedings, he was dismissed from service on 10.05.2003. 2/6
3. Subsequently, criminal case initiated against him in CC.No.1216 of 2002 has also been ended in acquittal on 16.06.2004. Thereafter, in the Industrial Dispute case in ID.No.267 of 2012, before the Labour Court, Chennai filed by the deceased against the dismissal order, ended in his favour by setting aside the dismissal order on 25.11.2014. It is submitted that against the said award made in ID.No.267 of 2012 dated 25.11.2014, the respondent has filed WP.No.6747 of 2015 before this Court and the writ petition was dismissed on 18.07.2023.

Consequent to the demise of the petitioner's husband on 19.07.2021, the petitioner had submitted a representation dated 09.08.2021, to the respondent herein, to confer the death benefit, family pension and compassionate appointment to her 2nd son namely U.Surya in any of the existing vacancy and also confer all other family benefits. However, there is no response. Therefore, the petitioner is before this Court.

5. Heard the learned counsels on the either side and perused the records.

Considering the fact that the petitioner's representation dated 09.08.2021 has not been considered to date, the respondent is directed to consider the petitioner's representation dated 09.08.2021 and pass orders on merits within a period of 1 month from the date of receipt of a copy of this order.
7.The Writ Petition is allowed. Consequently, the connected miscellaneous petition is closed. No costs.
