The petitioner, who was arrested and remanded to judicial custody on 29.04.2023 for the offences punishable under Section 6.5(m) and 5(n) of POCSO Act and Section 323, 506(i) of IPC in Crime No.4 of 2023 on the file of the respondent police, seeks bail. 2.The petitioner is the accused in Crime No.4 of 2023. The victim child is the daughter of the petitioner. The statement under Section 164 Cr.P.C., had been perused. It is stated that the final report had been filed and taken cognizance in Spl.S.C.No.165 of 2023 before the Special Court for exclusive trial of cases under POCSO Act, Chennai. It is also stated that the victim child had not yet been examined. 3.Let the victim child and the defacto complainant tender evidence and also be cross-examined and that will be a substantial change in circumstance. At this stage, I am not inclined to grant bail to the petitioner. Accordingly, this criminal original petition stands dismissed.
