The petitioner herein was arrested on 26.07.2025 for the alleged offence punishable under Section 64 of BNS, 2023.

The learned counsel appearing for the petitioner submitted that due to a money dispute, a false allegation of forcible sexual intercourse has been made against the petitioner. He further submitted that the alleged occurrence is stated to have taken place in the month of November 2024, whereas the complaint was lodged belatedly on 24.06.2025. On the basis of false complaint, the petitioner has been incarcerated since 26.07.2025. 3.
On perusal of the First Information Report and the statement recorded under Section 164 Cr.P.C., from the victim, appears to be forcible sexual intercourse committed by the petitioner by exploiting their relationship. Since the act of crime is stated to be a continues affair, the complaint has been lodged. Considering the investigation is at nascent stage, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition stands dismissed for the present.
