1.The Superintendent of Police, Gopalapuram, Coimbatore.
2.The Assistant Commissioner of Police, Pothanur, Coimbatore District.
3.The Inspector of Police, Kovilpalayam Police Station, Kovilpalayam, Coimbatore-641 107 ... Respondents Prayer: Criminal Original Petition is filed under Section 482 Cr.P.C.,/ 528 BNSS, pleased to direct the respondents 2 and 3 herein not to harass the petitioners For Petitioners : Mr.R.Nalliyappan For Respondents : Mr.K.M.D.Muhilan Government Advocate (Crl.Side) 1/4
O R D E R
The petitioners herein are husband and wife. They have collected deposits from the public as investment in their stock brokerage company, have run into loss and failed to repay the money collected. Fearing danger to their life at the hands of the investors, the present petition is filed seeking protection.
2.
The learned counsel appearing for the petitioners states that seeking protection from the investors, the petitioners have given a representation to the police, but till date the police has not provided any protection.
3.
The learned Government Advocate (Crl.Side) appearing for the respondent police states that on receipt of his representation, police has caused summons to the petitioners to appear for enquiry. However, it was found that the petitioners are not in the given address and absconding. He further submits that fearing complaints against them by the investors to pre-empt criminal action, this present petition is filed. 4.
This Court, on perusing the records, finds that the prayer 2/4
sought is an indirect way of preventing police from taking action against them for cheating, hence the petition prayer is not sustainable. Therefore, this Criminal Original Petition stands dismissed. 04.10.2024 Index : Yes/No rpl To 1.The Superintendent of Police, Gopalapuram, Coimbatore.
