C.M.P.Nos.12235, 12236 and 12237 of 2017 in S.A.No.53 of 2017 R.SAKTHIVEL, J., These petitions have been filed by the petitioner to condone the delay of 274 days in filing the petition to set aside the abatement of the above second appeal as against the first respondent; to set aside the abatement caused due to the death of the first respondent; and to bring on record the legal heirs of the deceased first respondent as respondents 5 and 6 in the above second appeal.

2. Heard the learned counsel for the petitioner.

3. Accepting the reasons stated in the affidavit filed in support of these petitions, this Court is inclined to allow these petitions. Accordingly, these petitions are allowed as prayed for.

4. The Registry is directed to carry out the necessary amendments in the second appeal.
