This Criminal Miscellaneous Petition is filed to extend the time for a further period of six months to complete the investigation and file a final report as per the direction given by this Court in Crl.O.P.No.11098 of 2022 dated 21.03.2022.
2. Heard the learned Additional Public Prosecutor appearing for the petitioners and the learned counsel for the respondent.
3. The respondent is a sole accused in the case involved in Crime No.4099 of 2020 on the file of the Inspector of Police, N-1 Royapuram Police Station, Chennai.
4. The learned Additional Public Prosecutor appearing for the petitioners submitted that the investigation is still pending and certain important materials have to be collected and that is the reason why the investigation could not be completed and hence further time is required. 1/4

The learned counsel for the respondent submitted that on the petition filed by the respondent in Crl.O.P.No.11098 of 2021, seeking transfer of the investigation pending on the file of the second respondent to the competent agency, an order has been passed; in the said order, a direction was given to transfer the investigation pending on the file of the Inspector of Police, N-1, Royapuram Police Station, Chennai to the Assistant Commissioner of Police, Washermenpet, Chennai; despite the direction was given to finish the investigation by four months and the Deputy Commissioner of Police, Washermenpet Zone, was also directed to monitor the investigation, so far the said direction has not been complied and hence the petition has to be dismissed.
6. The accused has been charged for the offence under Sections 341, 294(b), 506(2), 307 of I.P.C., and Section 25(1)(a) of the Arms Act. Though it is obligatory on the part of the petitioners to comply the direction in letter and spirit, they should not be allowed to defeat the ends of justice. Since the petitioners have filed a petition seeking time by stating specific reason as to why the investigation has not been completed, I feel short extension of time for two months shall be granted.

7. Accordingly, time is extended for a further period of two months from the date of receipt of a copy of this order to comply the order passed by this Court in Crl.O.P.No.11098 of 2021 dated 21.03.2022. 30.11.2022 gsk 3/4
