Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents to pay the unpaid salary from 01.12.2021 to 19.06.2022 and subsistence allowance during the suspension period from 20.06.2022 to till date by considering the Petitioner's representation dated 04.08.2025 to till date with interest of 14 %.

The Writ Petition is filed for the following relief: "directing the respondents to pay the unpaid salary from 01.12.2021 to 19.06.2022 and subsistence allowance during the suspension period from 20.06.2022 to till date by considering the Petitioner's representation dated 04.08.2025 to till date with interest of 14 %". 2/6

2. The petitioner was appointed as a Night Watchman in the respondent Society on 03.04.1989. His service was regularised on 03.01.1991. On 03.01.2021 the petitioner was promoted as a Junior Clerk / Fertilizer Sales Man. The petitioner has rendered more than 33 years of service in the respondent Society. Whileso, an Inspection under Section 82 of the TNCS Act, 1983 was ordered to look into the affairs of the Society and certain irregularities were found. Based on the Inspection report the petitioner was suspended from service on 20.06.2022.

3. The petitioner would submit that the 3rd respondent has not paid the salary from 01.12.2021 to 19.06.2022 and also the subsistence allowance from the date of suspension i.e., 20.06.2022. Aggrieved by the same the petitioner sent a representation dated 04.08.2025 requesting the respondents to pay salary from 01.12.2021 to 19.06.2022 and subsistence allowance from 20.06.2022. However, there is no response. Therefore, the petitioner is before this Court. 3/6

4. Heard the learned counsels on the either side and perused the records.

Considering the fact that the petitioner has not been paid salary from 01.12.2021 to 19.06.2022 and subsistence allowance from 20.06.2022 and also the fact that his representation has not been considered to date, the respondents are directed to consider the petitioner's representation and pass orders within a period of 2 months from the date of receipt of a copy of this order.

6. The Writ Petition is allowed with the above direction. Consequently, the connected miscellaneous petition is closed. No costs.
