The petitioners/A1 and A2 herein seek anticipatory bail in Crime No.36 of 2023 registered by the respondent Police for the offences under Sections 3(2)(a), 4(1) and 5(1)(a) of Immoral Traffic (Prevention ) Act, 1956.
2. The learned counsel for the petitioners stated that they have been falsely implicated as accused in this case. They are innocent persons. The 3rd accused had been remanded and later released on bail. Thus, he seeks bail to the petitioners.
3. It is the case of the prosecution that the respondent received an information about the running of prostitution net at Mylapore. One of the police constable had gone there and found the 3rd accused with the victim girl. The victim girl had been rescued and the 3rd accused had been taken into custody.
4. Learned Government Advocate (Criminal side) stated that it is the petitioners herein who had taken the particular place for rent and used that place for the purpose of running brothel. 1/3
5. The conduct of the petitioners cannot be accepted. They should never use any place for any immoral purposes. This Court is of the view that further investigation has to be done with respect of modus oprendi. Therefore, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed. 19.10.2023 gd 2/3
