Respondents PRAYER: The Writ petition filed under Article 226 of the Constitution of India seeking to issue a Writ of Mandamus forbearing the respondents 3 and 4 to continue the service of the 123 members of the petitioner Union for the work of collecting parking fees and lane management at Chennai Airport by providing suitable clause in the notice inviting tender dated nil.11.2022 to continue to engage the 123 members of the petitioner union as provided in the previous tender notification till the industrial dispute raised by them for regularization is decided by the competent industrial adjudicator pursuant to the dispute raised by the petitioner union on 20.06.2022 before the 2nd respondent.

Both sides' counsels present and represented that a fresh contract was awarded and the employees in the petitioner Union were replaced as fresh 2/4
contract employees. Therefore, the prayer in this petition becomes 'infructuous'. The petitioner Union is at liberty to approach the Labour Court for appropriate remedy..
