The petitioner, who was arrested and remanded to judicial custody on 17.03.2023 registered by the respondent Police for the offences under Sections 8(c) r/w 20(b)(ii)(B) and 25 of NDPS Act, in Crime No.77 of 2023, seeks bail.

2.It is stated that the petitioner was found in possession of 5.00 kgs of Ganja.

3.The learned counsel for the petitioner stated that the contraband seized from the petitioner is an intermediate quantity and therefore, Section 37 of NDPS Act would not be attracted.

4.It is seen that before the trial Court, the Calender Case is next listed on 07.11.2023 for furnishing of copies. 5.A direction is issued to the learned trial Judge to frame the charges against the petitioner without any delay. 6.The learned trial Judge may also ensure that the copies under Section 207 of Cr.P.C are served without any delay. 7.At this stage, this Court is not inclined to grant bail to the petitioner.
