illegal removal of sand in S.No.126/3 in Aduvapatti, Pakkanadu Post, Edapadi Taluk, Salem District belonging to the fifth respondent and thereby preventing the petitioner compound wall being fallen. ORDER
This Writ Petition has been filed for a direction directing the respondents 1 to 4 to take action on the representation of the petitioner dated 16.08.2022 for the illegal removal of sand in S.No.126/3 in Aduvapatti, Pakkanadu Post, Edapadi Taluk, Salem District belonging to the fifth respondent and thereby preventing the petitioner compound wall being fallen.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4. Though notice has been served on the fifth respondent, none appeared on behalf of the fifth respondent either in person or through counsel.
3. It is seen that on receipt of the complaint, the same was
forwarded to the Deputy Director, Geology and Mining, Salem. After due enquiry, it is found that the fifth respondent has involved in illegal quarrying operation in her patta land in S.F.No.126/3 to an extent of 0.15.0 hectares and removed 1500 cubic meter of red soil. In this regard, the Deputy Director, Geology and Mining Department, Salem, has forwarded the proposal to the Sub Collector, Mettur, to initiate necessary penal action against the offender vide its communication dated 24.03.2023 in Rc.No.1514/2022/Mines-D.
4. In view of the above, the Sub Collector, Mettur, is directed to initiate the penal action as against the fifth respondent in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this writ petition stands allowed. No costs.
