Respondent PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, praying to direct the respondent police to take immediate action on the complaint dated 06.10.2022 lodged by the petitioner's father and to provide police protection to the petitioner, while he re-fix the boundary stones in its original places as identified by the Head Surveyor, Sholinganallur and fence around of his land situated at Plot No.1, Pandiyan Nagar, Vettuvankani Village, Sholinganallur Taluk, Kancheepuram District, measuring 2204 sq.ft. and comprised in Old Survey No.164/17-B, New Survey No.165/90.

This Criminal Original Petition has been filed to direct the respondent to provide police protection to the petitioner and his land by considering the representation dated 06.10.2022. 2.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent. 3.

The learned counsel for the petitioner submitted that the petitioner has already surveyed the land with the help of surveyor and with the protection of police and now he wants to put up the boundary stones. Since the same is being prevented by some antisocial elements, he has given a renewed representation for seeking police protection for laying the boundary stones. He further submitted that despite the lands have been surveyed and it has been fenced earlier and that was disrupted by some antisocial elements, who claims that the land is meant for volleyball court. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondent submitted that on the representation given by the petitioner, current paper enquiry has been initiated in C.S.R.No.809 of 2022 and the petitioner has been called for an enquiry but he is not turned up. 5.

Since the petitioner was not aware of the intimation sent by the respondent, the learned counsel for the petitioner now submitted that on getting intimation from the respondent, the petitioner would any time co-operate and appear before the respondent police for enquiry. In that case, the respondent police is directed to consider the representation of the petitioner dated 06.10.2022 and do the needful in accordance with law within a period of three weeks from the date of receipt of a copy of this order.

With these observations, this Criminal Original Petition stands disposed of.
