ORDER

This writ petition has been filed challenging the impugned notice issued by the 2 nd respondent dated 23.07.2025 informing the petitioner to pay a sum of Rs.7,48,169/- on the ground that one phase energy was not recorded for the period from 04.03.2015 to 24.08.2020.

2. Heard Mr.R.Saravanakumar, the learned counsel for the petitioner and Mr.L.Jaivenkatesh, the learned Standing counsel for the respondents.

3. The petitioner filed the earlier writ petition in W.P.No.3385 of 2021 challenging the proceedings of the Electricity Board demanding for the payment of Rs.8,17,317/-. This writ petition along with another connected writ petition were disposed by an order dated 14.03.2024 by interfering with the impugned proceedings and directing the Electricity Board to issue fresh notice to the petitioner by providing opportunity of hearing and thereafter, pass appropriate orders.

4. Pursuant to the above order, the impugned notice was issued to the petitioner and petitioner has approached this Court.

5. In the considered view of this Court, the 2 nd respondent has not made any demand from the petitioner for the payment of Rs.7,48,169/-. The 2 nd respondent has only informed the petitioner that if the petitioner has any

grievance/difficulty or if the petitioner wants any clarification on this shortfall amount, it will always be left open to the petitioner to approach the 2 nd respondent and submit a representation. In view of the same, the 2 nd respondent has only provided opportunity to the petitioner and has not straight away demanded amount from the petitioner. This notice was issued pursuant to the order passed by this Court in W.P.No.3385 of 2021.

In the light of the above discussions, the petitioner is directed to submit his representation to the 2 nd respondent for the notice dated 23.07.2025 within a period of two weeks from the date of receipt of a copy of this order. Thereafter, the 2 nd respondent shall enquire the same as per the earlier order passed by this Court in W.P.No.3385 of 2021 and take a decision on merits and in accordance with law as expeditiously as possible.
