Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus to CALL FOR the RECORDS connected with the proceedings issued in no RC no. 5273/2004 no. Rc. 5275/2004 dated 18.01.2022 passed by the 2nd respondent and quash the same and consequently direct the 2nd 1/4

respondent to reinstate the petitioner into service with all attendant benefits.

O R D E R

This writ petition has been filed challenging the order of suspension dated 18.01.2022 on the file of the second respondent. 2.

The petitioner had joined as Probationary Accountant in the second respondent society. While being so, she was suspended from service by order dated 18.01.2022 along with her husband who is working as Receipt Writer in the second respondent society on the ground that the petitioner had wordy quarrel when there was altercation between the petitioner and a co-employee who was working as Receipt Writer. Therefore, a criminal complaint was given and criminal case was registered against the petitioner for the offence punishable under Section 294(b), 324, 506(i) r/w 34 of IPC against the petitioner and her husband. 2/4

After filing final report, the same culminated into trial in CC.No.1078 of 2022 on the file of the Judicial Magistrate, VII Court, George Town, Chennai. After fullfledged trial, the petitioner and her husband were acquitted from criminal case. No disciplinary proceedings has been initiated against the petitioner so far. However, the order of suspension is still in force. Therefore, keeping the petitioner under suspension would not serve any purpose for the criminal case between her husband and her colleague.

In view of the above, the impugned order of suspension cannot be sustained and the same is liable to be set aside. Accordingly, the impugned order dated 18.01.2022 is set aside. The second respondent is directed to reinstate the petitioner into service forthwith with all attendant benefits.

With the above direction, this writ petition is allowed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
