O R D E R

This Criminal Original Petition has been filed to quash the proceedings in C.C.No.4327 of 2016, on the file of the Fast Track Court - 1, XIII Metropolitan Magistrate Court, Egmore, Chennai.

2.It is seen from the records that the cross examination of PW1 is over. Hence, all the points raised by the petitioner cannot be considered by this Court. However, the petitioner is at liberty to raise all the points before the trial Court during trial.

3.In view of the above, this Court is not inclined to quash the proceedings, however on considering the facts and circumstances of the case, the personal appearance of the petitioner before the trial Court is dispensed with except on the dates, which the trial Court insisted for framing of charges, preliminary question under Section 311 of Cr.P.C and on the date of judgment. The trial Court is directed to complete the trial within a period of three months from the date of receipt of a copy of this order.

4.With the above directions, the Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is closed.
