PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Court Act, 1971 praying to punish the respondent for committing wilful breach of undertaking given by the respondent in C.R.P.NPD.No.631 of 2019, by filing affidavit sworn on 10.03.2019 and thereby undertook to vacate and hand over vacant possession of the property of the petitioner namely Ground Floor, No.16, Door No.28/38, Gandhi Road, Alwarthirunagar, Chennai-600087 within six months. 1/3

O R D E R

The above Contempt Petition has been filed since the respondent had failed to comply with the undertaking given by him before this Court vide his affidavit dated 10.03.2019.

2. After notice was issued to the contemnor, it is now represented that the contemor has vacated and handed over the possession of the property. He has also filed an affidavit dated 03.02.2020 wherein he has expressed a regret and apologised for not having complied with the undertaking given by him before this Court earlier. The affidavit would further state that possession was handed over on 29.01.2020.

3. This Court has taken note of the affidavit filed by the contemnor today.

4. In view of the fact that he has complied with the undertaking given by him, the CP is closed.
