Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus or any other appropriate writ or order of direction more so in the nature of a Writ, directing the respondents to open the Office of Block Educational Officers, Urdu then Assistant Elementary Educational Officers, Urdu, and fill up the four posts of Block Educational Officers, Urdu, so as to enable the Urdu Medium Schools are effectively administered.

O R D E R

This Writ Petition has filed for the issuance of Writ of Mandamus, directing the respondents to open the Office of Block Educational Officers, Urdu then Assistant Elementary Educational Officers, Urdu, and fill up the four posts of Block Educational Officers, Urdu, so as to enable the Urdu Medium Schools are effectively administered.

2. The case of the petitioner is that he is the General Secretary of the Tamil Nadu Urdu School Teachers Association. The said association was formed by the Teachers working in Urdu Medium Schools with Urdu qualifications. While being so, the Government issued G.O. restructuring the designation of various officers in the Education Department in G.O.Ms.No.101 School Education dated 18.05.2018. As per the above said G.O., the post of Assistant Elementary Education Officer and Additional Assistant Elementary Education Officer were renamed as Block Educational Officer. In the old system, the Assistant Elementary Educational Officers were administering the School and as far as, Urdu Schools are concerned, only the Urdu qualified officers were appointed for the said post.

Therefore, according to the number of Urdu speaking people and Urdu medium schools, the entire Tamil Nadu was divided as three ranges i.e. Salem, Vellore and Cuddalore. These schools are inspected by the concerned Assistant Elementary Educational Officers, Urdu. Since, there are no Urdu Medium Schools in the rest of the districts in Tamil Nadu, there is no Office of the Assistant Elementary Educational Officer, Urdu.

The grievance of the petitioner is that, though the above said G.O.was implemented in the year 2018, the respondents have not posted any person for the post of Block Educational Officer despite many qualified persons are working as Middle School Headmasters in Urdu. Hence, the petitioner's association made a representation dated 04.01.2019 to the respondents regarding the same. Till date, the said representation was not considered by the respondents. Hence the present writ petition.

4. The learned counsel for the petitioner would submit that it would suffice to issue direction to the second respondent to dispose of the representation in accordance with law.

5. Considering the facts and circumstances of the case and the limited request made by the learned counsel for the petitioner, I am inclined to issue a direction to the second respondent to dispose of the representation, if not disposed of 2/3

already, within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
