The petitioner, who was arrested and remanded to judicial custody on 14.06.2025 for the offence under Sections 64(1), 67(1)(A) of IT Act and Section 6 of POCSO Act in Crime No.182 of 2025 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the defacto complainant is the son of the victim women. It is alleged that the petitioner sexually assaulted the complainant's mother by having intercourse with her and the same was captured as videos and photos on his mobile phone and he transmitted the said obscene videos and images to the complainant's mobile number through whatsapp. It is further alleged that the petitioner also sexually assaulted another victim girl, who is aged about 17 years, by having sexual intercourse with her on various occasions. Hence, this complaint. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that based on a false complaint arising out of money dispute, he may be released on bail.

4.The learned Government Advocate(Crl.Side) submitted that the modus operandi of this petitioner is to commit aggravated penetrative sexually offence by force and taken photos and videos of the victim to extort money from the victim. Sofar two of the victims have been identified and their statements were recorded. There are two more victims is to be investigated.
5.Considering the statements of the victims, one minor girl, another elderly lady, recorded under Section 183 of BNSS, the modus operandi of the petitioner herein while committing the crime was disclosed. Considering the nature of the offence and the fact that the investigation is yet to be completed, this Criminal Original Petition stands dismissed. 01.09.2025 ari Note :
