Respondent/ Respondent/ Respondent PRAYER: The Civil Revision Petitions are filed under Section 25(1) of the Tamil Nadu Buildings (Lease and Rent Control) Act 18 of 1960 as amended by Act 23 of 1973, against the order and Judgment in R.C.A.No.916 of 2006 dated 17.03.2017 on the file of the IX Judge, Court of Small Causes, Chennai against Judgment dated 24.08.2006 passed in R.C.O.P.1659 of 2004 on the file of the XIV Judge Small Causes Court, Chennai. In the above Civil Revision Petition No.2917 of 2017, an affidavit of undertaking has been filed by one Syed Akbar, who was arrayed as the third petitioner and the affidavit has filed on behalf of the second petitioner as well. The petitioners undertook to vacate and hand over the vacant possession of the suit premises within a period of eight months from todate and will handover the vacant possession on or before 31.08.2019 and they undertook to continue to pay the rents without any demur and also the arrears of rents if any. It is made clear that, if even a months rent is defaultéd, the landlord is free to immediately institute execution proceedings. It is also stated by the learned counsel for the petitioners that till date there was no arrears of rent payable and the future monthly rents will be paid in time. 2.Recording the above, the Civil Revision Petition is allowed.
