O R D E R

The petitioner, who was arrested and remanded to judicial custody on 19.07.2025, for the offence punishable under Sections 296(b), 332(c), 75(1)(i), 75(2) and 76 of BNS, 2023 and Section 7 read with 8, 9(1) read 1/4

with 10 and 11(i), 11(iv) read with 12 of POCSO Act, 2012, in Crime No.222 of 2025, registered on the file of the respondent, seeks bail.

2. The petitioner and the defacto complainant are relatives. For the alleged incident said to have occurred during the month of February, a complaint was lodged only on 19.07.2025. In the interregnum, it appears that there was a quarrel between the brother of the victim girl and the accused, which resulted in a criminal case against the victim girl's brother, who was remanded to judicial custody and later released on bail. The statement of the victim girl has already been recorded.

3. Heard both sides and perused the materials available on record.

4. Considering the nature of the complaint, this Court is inclined to grant bail to the petitioner, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Special Court for Exclusive Trial of Cases under POCSO Act, Tiruvannamalai and on further conditions that: 2/4

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioner shall stay at Tiruvannamalai and report before the Tiruvannamalai Town Police Station daily at 10.00 a.m., until further orders. He shall not enter the village where the victim girl resides;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 21.08.2025 rpl Dr.G.JAYACHANDRAN, J.
