O R D E R

The petitioner herein, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(4), 296(b), 351(2) of BNS in Crime No.104 of 2025 on the file of the respondent Police, seeks anticipatory bail. 2.

The case of the prosecution is that, the petitioner herein formed a Women self help group society in the name of Sindhunadhi with 30 members; that thereby collected money from them on the promise of return back the same with interest to the tune of Rs.46,626/- to each of the 30 members, totalling to Rs.13,98,780/-; that however, the petitioner had so far returned only Rs.6,75,000/- to the members and subsequently, cheated the remaining amount. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that a false case has been foisted against the petitioner herein; that the collected amount from the members have been repaid back to them; and that the petitioner is ready to abide by any conditions that may be imposed by this Court and to co-operate for the investigation, hence sought for anticipatory bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the 2/4

respondent police while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the victims in this case were examined and the investigation of this case is pending.

Considering the submissions made, facts and circumstances of this case, nature of allegation and taking note of the fact that still nearly a huge sum of Rs.7,00,000/- is yet to be recovered in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
