The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 4(1)(aaa), 4(1-A)(ii) of TN Prohibition Act in Crime No.507 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.This is the second anticipatory bail petition of the petitioner herein. He had also filed Crl.O.P.No.22577 of 2023, which was dismissed by an order dated 29.09.2023.

3.The case of the prosecution is that on 19.08.2023, the petitioner and associates illegally possessed 90 ml Old Secret XXX Rum 96 pockets and Karnataka Government Pockets 432 litres. Hence the complaint. 4.The learned counsel for the petitioner would submit that the petitioner was falsely implicated in this case and he is an innocent person. Thus, the learned counsel for the petitioner seeks grant of anticipatory bail to the petitioner.

5.The learned Government Advocate (Crl. Side) would submit that the petitioner was in possession of 90 ml Old Secret XXX Rum 96 pockets and Karnataka Government Pockets 432 litres. Therefore, he vehemently opposed to grant anticipatory bail to the petitioner. 1/2 https://www.mhc.tn.gov.in/judis

sli 6.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent Police. 7.It is seen that there is no change in circumstances from 29.09.2023 when the earlier anticipatory bail petition was dismissed. It is also seen that there are previous cases similar in nature pending against the petitioner herein. Therefore, I am not inclined to grant anticipatory bail to the petitioner.
