The Civil Miscellaneous Appeal has already been disposed of, however, the claimants have filed the present Civil Miscellaneous Petition to direct the 2nd respondent Insurance Company to deposit the balance amount, disputing the calculation.

2. It is seen that the difference between both sides is due to the TDS deduction at the rate of 20%. However, it is now represented that with regard to the payment, a copy of the PAN card has been furnished and thereafter 10% alone is deducted and the balance 10% is not paid and that the calculation is now accepted by both sides. However, the learned counsel for the claimants submits that the TDS certificate has to be furnished to them.

3. Learned counsel for the Insurance Company submits that since the deduction is of the year 2018, it may take sometime as they have to submit particulars.

4. Considering the facts and circumstances of the case, since both the parties agreed the total calculation, we are inclined to close this petition,

however, with a direction to the 2nd respondent Insurance Company to furnish the TDS certificate within a period of eight weeks from the date of receipt of copy of this order. Accordingly, the Civil Miscellaneous Petition is closed.
