Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the rejection order, dated 03.05.2017 pertaining to the package Nos.SLM3/2016-17, RDTN_71828_3; SLM 6/2016-17, RDTN_71828_6 in ROC.No.NA.Ka.No.428/2017/A4 dated 13.04.2017 on the file of the 2nd respondent to quash the same and direct the respondents to restore the bid of the petitioner and proceed the same in accordance with law.

2. When the matter is taken up for hearing, the learned counsel appearing for the petitioner stated that he has no submission to make and prayed this Court to pass any order on merit.

3. However, the learned Government Advocate for the respondents 1 and 3 upon oral instructions received from the previous counsel for the respondents submits that already tender was awarded to the successful bidder and part of the work has already been completed, and hence, the prayer sought in this Writ Petition has become infructuous.

4. In view of the above submission made by the learned Government Advocate for the respondents 1 and 3, this Writ Petition is dismissed as infructuous. No costs.
