The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 324 and 506(ii) of IPC r/w Section 3 of TNPPDL Act, in Crime No.144 of 2022, seek anticipatory bail.

2. The case of the prosecution is that there was a dispute between the defacto complainant's father-in-law and the accused persons. When the same was questioned by the defacto complainant, he was abused and they also attacked him with stones. It is further alleged that when the injured was taken to the hospital in an auto, the auto was damaged by them by pelting stones. Hence, the complaint.

3. The learned counsel for the petitioners would submit that the petitioners are the innocent persons and they have not committed any offence as alleged by the prosecution. Therefore, he prays for grant of anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor would submit that there are totally 6 accused in which the petitioners are arrayed as A1 & A4 and they are having 3 previous cases each against them and they are history sheeters. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

5. It is seen that already this Court dismissed the anticipatory bail petition filed by the petitioners after considering the previous cases against the petitioners and this is the second anticipatory bail petition. However, there is no change of circumstances in this case. As such, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this criminal original petition is dismissed. 22.11.2022 lok
