The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379 and 430 of IPC in Crime No.242 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioners have involved in transport of 1 unit of lake sand illegally by using JCB. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that he is no way connected with the alleged offence. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner has involved in transport of 1 unit of lake sand by using JCB without any valid license. He would further submit that there are three previous cases similar in nature pending against him. Hence, he opposed for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

5. Taking into consideration the facts and submissions made by the learned Additional Public Prosecutor and also the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
