ORDER

The Tahsildar, Thiruporur is suo motu added as the 4th respondent in this writ petition.

2.This writ petition has been filed for a direction to the 1st respondent to deal with the representation made by the petitioner on 18.02.2025, wherein, the petitioner has sought for the cancellation of the legal heirship certificate issued pursuant to the demise of the petitioner's father by adding the name of the 2nd and 3rd respondents by the 4th respondent.

3.Heard Dr.S.Diraviam Dinesh, learned counsel appearing on behalf of the petitioner and Mr.R.Neelakandran, learned Additional Advocate General appearing on behalf of the 1st respondent.

3/6 4.The specific case of the petitioner is that she is the only daughter of the deceased Kesavan born through Poongothai. According to the petitioner, the 2nd respondent is the sister of Poongothai and the 2nd respondent never married the said Kesavan and the 3rd respondent was not born to Kesavan. However, after the demise of Kesavan, legal heir ship certificate has been issued by adding the name of the 2nd and 3rd respondents. Aggrieved by the same, the petitioner made a representation to the District Collector seeking for cancellation of the legal heirship certificate. The same was forwarded to the Revenue Divisional Officer, and thereafter, there was no progress. It is under these circumstances, the present writ petition has been filed before this Court seeking for appropriate directions.

5.Taking into consideration the facts and circumstances of the case and considering the grievance expressed by the petitioner and the materials placed before this Court, there shall be a direction to the petitioner to submit a fresh application before the impleaded 4th respondent along with all the particulars

4/6 and on receipt of the same, the 4th respondent shall conduct an enquiry by affording opportunity to the 2nd and 3rd respondents and take a decision, within a period of eight weeks from the date of receipt of the application from the petitioner.
