ORDER

Mr.K.Surendran, learned Additional Government Pleader accepts notice on behalf of the respondent. With the consent of both the learned counsels, the main writ petition itself is taken up for final disposal at the admission stage. 2.The writ petition is for a mandamus directing the respondent to complete the enquiry and pass orders on the petitioner's representation dated 08.03.2024, to take legal action against the persons mentioned therein and to take departmental action against the Tahsildar within the time stipulated time to be fixed by this Court.

3.When the matter is taken up for hearing, the learned Additional Government Pleader would submit that the petitioner has sent a representation on 08.03.2024, complaining about the transfer of Patta in the names of the third parties in respect of the petitioner's patta land. Based on the representation of the petitioner, an enquiry was conducted and the District Revenue Officer had 2/5

issued a direction to conduct a fresh enquiry, pursuant to which, the enquiry was conducted on 29.04.2024 and again on 19.09.2024 and once again on 26.12.2024. The Village Administrative Officer and Zonal Deputy Tahsildar have appeared for enquiry and statements have been obtained from them. Learned Additional Government Pleader submitted that the petitioner did not appear for enquiry and in the meanwhile, in respect of the issue concerning transfer of Patta, a suit has been filed by the petitioner in OS.No.15/2017 on the file of the Sub Court, Gobichettipalayam and it is pending. He would submit that based on the documents submitted by the petitioner, the enquiry has been conducted and the representation of the petitioner will be considered and orders will be passed at the earliest.

4.Heard both sides and perused the materials placed on record. 5.Under the facts and circumstances of the case, a direction is issued to the respondent to consider and pass orders on the representation of the petitioner dated 08.03.2024, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that this Court has not made any observations on the merits of the case. 3/5
