This Criminal Original Petition is filed by the wife alleging that the respondent police under the guise of investigating the complaint given by her husband is harassing her.

The learned counsel appearing for the petitioner submits that it is a matrimonial dispute between the petitioner and her husband and the petitioner has already initiated proceedings against her husband for domestic violence and the matter is pending. While so, to harass the petitioner, her husband has given a false complaint to the respondent police and under the guise of investigating the complaint, the police is harassing her.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that on the complaint given by Sivanesan Narayansamy, the husband of the petitioner, police has registered C.No.139 of 2024 and after enquiring the parties the complaint has been closed since the complainant Sivanesan has reported that he will work out the remedy before the civil Court.

Since the complaint has already been closed, there is no necessity to pass any specific direction in this petition. However, the respondent police is directed not to interfere in the matrimonial dispute unless and until if there is any cognizable offence is made out. 5.

In the result, this Criminal Original Petition is disposed of. 2/4
